EB-1

EB-1 brings together three employment-based immigration pathways. EB-1A is for individuals with extraordinary ability; EB-1B, for outstanding professors and researchers; and EB-1C, for certain multinational executives and managers. Each subcategory has its own criteria.

EB-1A · Extraordinary ability

For professionals in science, the arts, education, business or athletics with sustained national or international acclaim. Applicants must demonstrate that they are among the small percentage at the top of their field and intend to continue working in that field in the United States. They may be in the United States or abroad and may self-petition without a job offer.

EB-1B · Outstanding professors and researchers

For professors and researchers internationally recognized in their academic field, with at least three years of teaching or research experience. An eligible tenured or tenure-track teaching offer, or permanent research position, is required. The U.S. employer files the petition and must meet the category requirements; the professional is the beneficiary.

EB-1B: evidence of academic recognition

At the EB-1B documentary stage, at least two of six criteria must be met: major prizes for outstanding achievement; membership in associations requiring outstanding achievements; published material by others about the academic work; judging the work of others; original scientific or scholarly research contributions; and authorship of scholarly books or articles in scholarly journals with international circulation. Comparable evidence may be considered when the criteria do not readily apply to the occupation. USCIS also evaluates the evidence as a whole to determine international recognition as outstanding in the academic field; meeting two criteria does not guarantee approval.

EB-1B: research with a private employer

For a permanent research offer from a private employer, the department, division or institute must employ at least three people full time in research activities and demonstrate documented accomplishments in the academic field. The offer and organization must meet the specific EB-1B rules. A researcher job title at just any company is not sufficient on its own.

EB-1C · Multinational executives and managers

For executives and managers with qualifying experience abroad who transfer to a U.S. company with an eligible corporate relationship. The U.S. company petitions for a permanent managerial or executive role. Unlike temporary L-1A status, EB-1C is a permanent residence pathway. Having L-1A status is neither required nor a guarantee of approval: experience, duties and the relationship between the companies must meet EB-1C requirements.

EB-1C: overseas experience and U.S. operations

EB-1C requires at least one year of managerial or executive employment abroad with a qualifying organization within the applicable three-year window. For someone outside the United States, the reference period precedes the petition; for someone already working in the United States for the qualifying organization, the assessment considers the relevant nonimmigrant entry and employment history. The U.S. company must have been actually doing business for at least one year before filing. Registering a company or maintaining an address for one year is not enough.

EB-1C: relationship, duties and business continuity

The U.S. company and foreign organization must maintain a qualifying ownership and control relationship and continue doing business until visa issuance or adjustment of status. The employer must offer a permanent, primarily managerial or executive position and demonstrate ability to pay the salary. A job title or shareholder status alone does not establish these requirements. EB-1C is not intended for entry to open an office that has not yet met the required period of operations.

Labor certification and EB-1 benefits

All three subcategories waive labor certification (PERM), removing that recruitment and assessment stage concerning qualified, willing and available U.S. workers. This can reduce process steps and costs without eliminating other requirements. EB-1A also waives employer sponsorship; EB-1B and EB-1C require an eligible employer.

Visa availability and other petitions

First preference does not mean immediate availability in every case. Review the Visa Bulletin, priority date and applicable adjustment of status (I-485) or consular processing rules. A petition in another suitable category, such as EB-2 NIW, may also be filed while EB-1 is pending, provided the requirements of each petition are met.

The ten EB-1A evidence criteria

A major internationally recognized award may satisfy the initial evidence requirement. Otherwise, applicants must demonstrate at least three of the ten criteria below. USCIS also evaluates the evidence as a whole and sustained acclaim; meeting three criteria alone does not ensure approval.

  1. Nationally or internationally recognized prizes for excellence in the field.

  2. Membership in associations requiring outstanding achievements judged by recognized experts.

  3. Published material about you and your work in professional or major trade publications or other major media.

  4. Original scientific, scholarly, artistic, athletic or business contributions of major significance in the field.

  5. Authorship of scholarly articles in professional or major trade publications or other major media.

  6. Display of your work at artistic exhibitions or showcases.

  7. A leading or critical role for organizations with a distinguished reputation.

  8. A high salary or other significantly high remuneration compared with others in the field.

  9. Judging the work of others, individually or on a panel, in the same or an allied field.

  10. Commercial success in the performing arts, demonstrated by box office receipts or relevant sales.

Frequently asked questions

Do I need a sponsoring employer?

It depends on the subcategory. EB-1A permits self-petitioning; EB-1B and EB-1C require an eligible employer. The assessment begins by identifying the pathway that fits your background.

What is EB-1 and what are its subcategories?

It is the first employment-based immigration preference for permanent residence. It includes EB-1A for extraordinary ability, EB-1B for outstanding professors and researchers, and EB-1C for multinational executives and managers.

Must I meet all ten EB-1A criteria?

No. The initial requirement is a major internationally recognized award or at least three criteria. Beyond that stage, the evidence as a whole must demonstrate extraordinary ability and sustained acclaim. Collecting documents without establishing their significance is insufficient.

Does EB-1 require labor certification?

No. EB-1A, EB-1B and EB-1C waive PERM. The waiver does not remove the employer requirement for EB-1B and EB-1C.

What are the benefits and main challenges?

EB-1 offers a permanent residence pathway without PERM and, for EB-1A, self-petitioning. The challenge is proving the requirements with consistent evidence of recognition, impact, experience or corporate relationships, depending on the subcategory. Availability and timelines must be checked for each case.

What changed in EB-1A guidance in 2024?

In October 2024, USCIS clarified consideration of team awards and past memberships and adjusted guidance on published material. It also clarified that non-artistic exhibitions require a properly supported comparable-evidence claim. This guidance does not waive the category requirements.
