R-1

R-1 involves an eligible US religious organization and a qualifying religious role. Membership in the denomination and the nature of the work must be established; working for a religious entity does not make every job eligible.

What to consider

Preparation considers religious membership history, the proposed role, working hours and support provided by the organization. Generally, two years of denominational membership and work of at least 20 hours per week are relevant. The petitioning organization must also demonstrate its eligibility.

Religious role and denominational membership

R-1 may cover ministers and people performing a qualifying religious vocation or occupation, in a professional or nonprofessional capacity. The work must be for the petitioning organization for an average of at least 20 hours per week. Membership in the religious denomination for at least the two years immediately preceding the application must be demonstrated. Merely administrative or secular support activities do not become eligible simply because they take place in a church or religious entity.

Requirements for the sponsoring organization

The U.S. entity must qualify as a bona fide nonprofit tax-exempt religious organization, an organization covered by a valid group tax exemption, or a nonprofit organization affiliated with the denomination and eligible for the category. Documentation must establish the applicable tax status, generally related to section 501(c)(3), the religious nature of the activity and the proposed compensation or support. The offer and working conditions must be genuine and documented.

I-129 petition and visa application

The process starts with the employing organization filing Form I-129 with USCIS, supported by evidence about the entity, religious membership, role, hours and support. The petition must be approved before the consular R-1 visa application. The consular stage involves Form DS-160, a passport, approval details and requested documentation. Petition approval is not visa issuance and does not guarantee admission to the United States.

Initial stay and extension

The initial period of R-1 status may be up to 30 months. An extension may allow up to another 30 months, subject to the general five-year limit of stay in this classification and applicable counting rules. An extension requires an application and proof of eligibility; it is not automatic. The authorized period on Form I-94 and the visa validity in the passport are different and must be monitored.

R-2 family members and permanent residence

A spouse and unmarried children under 21 may accompany or join the principal in R-2 classification. The ability to support the family must be demonstrated. R-2 dependents may study but are not employment authorized based on that status. R-1 is temporary: any permanent residence through a religious worker category, such as EB-4, requires a separate process, its own requirements and applicable availability.
